In the course of conducting real estate sales and loan closings generally, including the issuance of title insurance commitments and policies, our firm may collect nonpublic information about you from the following sources:
•information we receive from you such as on applications or other forms.
•information about your transactions that we secure from our files, or from others
•information we receive from a consumer reporting agency
•information that we receive from others involved in your transaction, such as the real estate agent or lender
We share this information within our firm to offer and provide services to customers and clients.
We do not sell your information.
Customers involved in real estate or loan transactions with the firm, in many instances, do not have an attorney-client relationship with the firm. If you are a customer and not a client of the firm, you are entitled to the disclosure above, and to know that it is policy of the firm that we may disclose any of the above information that we collect about our customers or former customers to those necessary in order to complete your transaction, such as lenders or realtors, and as required by law in response to a subpoena, to a government regulatory agency or to prevent fraud. After a transaction closes, we are required to provide certain information relative to your transaction to governmental taxing authorities and routine title information to our title insurance underwriters. Your attention is directed to the title underwriters separate privacy notices.
Clients of the firm, because of the attorney-client relationship, are entitled to confidentiality with respect to information provided to their lawyer in the course of the attorney’s representation, and such information will not be disclosed to third parties except as permitted under the rules of ethics governing lawyers in Florida, which generally limit disclosure as necessary to provide the particular legal services undertaken by the lawyer, to enforce our rights arising out of any agreement, transaction or relationship with the client or as otherwise permitted by the client.
We have physical security at our offices, passwords to protect our databases and virus/intrusion detection software. These measures and others we employ are not failsafe, but we will use reasonable efforts to maintain these systems and to keep our staff trained in their operation.
WE WILL USE REASONABLE EFFORTS TO ENSURE AGAINST DISCLOSURE OF ANY NONPUBLC PERSONAL INFORMATION ABOUT YOU WITH ANYONE FOR ANY PURPOSE THAT IS NOT SPECIFICALLY PERMITTED BY LAW (as to customers), OR THAT IS NOT PERMITTED BY THE RULES OF ETHICS GOVERNING LAWYERS IN FLORIDA (as to clients).
